What is Litigation?

Litigation happens when both parties are unable to work together to come to an agreement on how to settle their marriage and therefore need to take the matter to court. In Litigation, the attorneys and judges control what happens, how it happens, and when it happens by following the rules of court and laws. The process can take many months or even years. The last step in the litigation process is to go to trial where a Judge will read and listen to the evidence presented in the case and make a decision for the parties. Sometimes Judges make decisions neither spouse likes but are what is dictated by law. Most litigated cases do not make it to trial and are settled out of court.
